96-033-E     A county election commissioner may simultaneously serve as a circuit court baliff Cautioned regarding §25-4-101 and §25-4-105(1). [11, 21, 28]
96-035-E     A deputy circuit clerk performing election duties such as operating voting machines may not be elected to the county election commission and remain as a deputy circuit clerk performing election duties as it violates §25-4-105(3)(a). A county election commissioner performing election duties such as operating voting machines for primary elections conducted by party executive committees is contrary to the policy set forth in §25-4-101. 96-050-E     An individual serving on a municipal separate school board and on a municipal election commission should recuse himself from any action coming before the municipal election commission regarding a school bond issue election. Cautioned regarding §25-4-101 and §25-4-105(5). [4, 20, 21]
96-108-E     An individual may simultaneously serve as a county election commissioner and as a principal of a public school. Cautioned regarding §25-4-105(1) and (5). [20, 21]
96-112-E     An individual that has been elected to the office of county election commissioner may become an employee of the sheriff's department of the county as the elected and employment positions are in separate authorities of the county government thereby allowing the exception in §25-4-105(4)(h) to apply. Cautioned regarding §25-4- 105(1) and §25-4-101. [11, 13,21]
96-135-E     The conflict of interest laws do not prohibit a secretary to the board of supervisors from serving as a county election commissioner as the county board of supervisors and the county election commission or separate authorities and the exception found in Code Section 25-4-105(4)(h) applies. However, there may be problems under the election laws so the requestor was referred to the Attorney General. Cautioned regarding §25-4-105(1) and §25-4-101. [11, 14,21]
