COUNTY AGENCY OR DEPARTMENT
95-001-E     A county may lease office space for use by the circuit judge and court administrator from the brother of the circuit judge provided the circuit judge has no financial interest in and receives no pecuniary benefit from the leasing of the office. [9, 14, 27, 28, 31]
95-007-E     A county tourism commission may not contract with a moving and storage company partly owned by a member of the commission. [9, 11]
95-008-E     The appointment as assistant public defender of a salaried attorney in the county board attorney's law firm is not a violation if the individual and not the firm serves as board attorney; if the salaried attorney does not perform work for the board; or if the salaried attorney's public defender's salary does not accrue to the firm. Should any of the above occur there is a violation of 25-4-105(3)(a). [1, 9]
95-015-E     A county industrial development authority may purchase from the son of one of its board members the right-of-way for an access road to an industrial development site to be deeded to a municipality for designation as a public road, provided the son is entirely financially independent from his father and has no financial relationships existing with the father including any joint business interests. [6, 9, 19,31]
95-019-E     A sheriffs department may not lease from one of its deputy sheriffs a motor vehicle for use as a drug protection canine unit for $1.00 a month and provide the necessary liability and collision insurance coverage. [9, 11, 13]
95-036-E     A county tourism commission may not pay restaurant and motel expenses for groups and meetings related to tourism when the restaurant and motel are managed or owned by members of the county tourism commission. [9]
95-054-E     Deputy justice court clerks that own and operate a defensive driving school may accept traffic violators ordered to attend such a school as part of their sentence by a justice court judge serving the deputy clerk's employer/county, provided the clerk does not use his or her official position to influence a justice court judge to order traffic violators to attend the school in question. [9, 11, 29]
95-057-E     It is a violation of 109 and 25-4-105(2) for the spouse, parent or child of a county supervisor to be employed by an authority of the county government. [9, 11, 14, 23, 31, A]
95-062-E     It is a violation of 25-4-105(3)(a) for a county employee to be employed in more than one position or to personally contract with the authority of the county employing him but it is not a violation for the employee to perform work for different county departments. [9, 11]
95-069-E     It is not a violation of the conflict of interest laws if a state entity which has the primary responsibility of approving the financing for projects that create jobs and provide investment in the state receiving as an appointment to its board of directors an individual who is employed as the executive director of a county economic development commission when the state entity does not contract with the county economic development commission but does on occasion finance projects in the county. Cautioned as to 25-4-105(1), (3)(d) and (5). [B,1 1, 9, 14]
95-077-E     A county human resource agency:
1. may not enter into a contract with a former board member within one year of the end of the former member's term as such contract violates 109 and 25-4-105(2).
2. may have a purchasing agent that is related to another employee that works in close coordination with the purchasing agent but both must be cautious of 25-4-105(1) and 25-4-101. [9,11,31]
95-078-E     A trustee of a county economic development district may not be awarded a bid on a construction project financed by bond proceeds from the sale of general obligation bonds issued by the county board of supervisors at the request of the county economic development district as such a contract violates 109 and 25-4-105(2). [4, 9, K]
95-083-E     An appointee serving on a state commission that appropriates funds to a local entity the appointee's spouse serves as director which directly or indirectly increases the spouse's compensation violates Constitutional Section 109 and Code Section 25-4-105(2). Also, addresses penalties imposed by Code Sections 25-4-109, 111 and 113. [9,19, A, B, E]
95-085-E     It is not a violation of Code Section 25-4-105(3)(a) for a county road employee's company to contract with the county prior to July 1, 1994, nor is it a violation for a former county road employee to contract with the county after July 1, 1994.
References the Supreme Court's ruling in the McCullough case. [9, 11]
95-088-E     A county supervisor-elect's roofing company may contract with other public entities other than the supervisor-elect's county if the county is not appropriating funds to the other public entities or their projects. It violates Constitutional Section 109 and Code Section 25-4-105(2) for the supervisor-elect's company to contract with the supervisor-elect's county. [5, 9, 14, 20, M]

95-095-E     An executive director of a state subdivision may accept an appointment to a county tourism commission's board if the state subdivision is not contracting with the tourism commission. [9, 19]

95-103-E     A county tax assessor/collector may serve on the board of trustees of the community hospital owned by his county. The tax assessor/collector was cautioned regarding Sections 25-4-101 and 25-4-105(1). [9, 15, 24]

95-104-E     1. A chancery clerk-elect may not retain a position on the board of directors of the county's depository as to do so is prohibited by Section 25-4-105(3)(a).
2. A chancery clerk/county administrator may not serve on the board of director's of the county's depository as to do so is prohibited by Section 25-4-105(3)(a). [2, 9,11,26]
95-108-E     The conflict of interest laws and the definitions under the conflict of interest laws do apply to members of an industrial board established by a joint resolution of a municipal board and a county board of supervisors. [5, 6, 9, 14, 19, K]
95-110-E     A member of a board of directors of a county human resource agency may simultaneously serve as a member of the board of trustees of a community college even though the agency has a contract for professional services with the community college as the interests are competing interests of governmental entities. The requestor is advised to caution the member regarding Section 25-4-101. [9, 18]
95-115-E     A member of a governing authority that established a joint municipal and county economic development authority:
2. may not contact an industrial prospect directly concerning his property as a potential site when he learned of the industrial prospect by reason of his official position as to do so violates Section 25-4-105(5). Also, potential Section 109 and Section 24-4-105(2) problems.
3. may attend briefings by the economic development authority that concerns a potential site owned by the member. The member was cautioned regarding Section 25-4-105(1) and (5).
A board member of a joint municipal and county economic development authority:
4. may sell property to the municipality and/or county which will then donate it to an industrial prospect. The member was cautioned regarding Section 109 and Section 25-4-105(2).

95-120-E     A county board of supervisors may not lease a building to house a local library when the building is owned by a member of the county library advisory board of trustees. [9, 14, 19]
95-136-E     The conflict of interest laws do not prohibit a secretary to the board of supervisors and an assistant to the county administrator from serving as a county election commissioner as the county board of supervisors and the county election commission or separate authorities and the exception found in Code Section 25-4-105(4)(h) applies. However, there may be problems under the election laws so the requestor was referred to the Attorney General. [9, 11, 21]
95-152-E     1. A for-profit partnership controlled by a corporation solely owned by a county supervisor may receive a loan from a public body corporation to fund a multi family housing facility in a municipality located in the supervisor's county as long as the county is not authorizing the transactions.

94-017-E     A County Health Foundation may choose as a depository a bank which employees a supervisor's spouse when the supervisor is not a member of the Foundation.
94-021-E     A city fire chief may simultaneously serve as a Trustee of a county hospital and nursing home within the county.
94-040-E     An employee of a city/county economic and community development authority( EDA) may simultaneously serve as member of a county board of education.
94-068-E     A county board of supervisors is advised against appointing to a county Port Commission a person who is a stockholder and officer of a corporation that is a party to a contract with the county and the Port Commission.
94-079-E     A city/county hospital may enter into an agreement of employment with a physician to provide professional services and the use of the physician's building and equipment by the hospital.

94-080-E     1. An attorney representing a board of supervisors may represent a gambling casino in a county which has legalized gambling, provided the county represented by the attorney has no contracts with the casino represented by the attorney.

2. An attorney representing a board of supervisors may represent a hospital board which receives county money, provided the attorney recuses himself in the event of a possible conflict of interest.

3. An attorney representing a board of supervisors may represent a board or entity which may come before the board of supervisors for approval of
funding, with the same provisions found in 1 and 2.

94-099-E     A county airport board mat compensate a trust for an acquired easement as the trustees include an airport board members three adult children who are also the beneficiaries of the trust.

94-126-E     1. A law enforcement officer and his spouse may form a bail bonding company.

2. A law enforcement officer's spouse may write bail bonds for other bonding companies.

3. A law enforcement officer and/or the spouse of a law enforcement officer may not write bail bonds for the release of defendants into the custody of the law enforcement entity employing the law enforcement officer.

94-129-E     An elected County Commissioner of Elections may be employed and compensated by the County as an operator for the County's E-911 system.
94-145-E     A retiring Mayor may accept an appointment as a member of the County Advisory Board for the County Human Resource Agency when the city he or she served as Mayor provided during his or her term a rent free building to the County Human Resource Agency for housing senior citizen programs.
94-147-E     A billboard advertising company whose principal owner is a member of the board of trustees of a community hospital may not contract with a private individual to build and service an outdoor advertising sign which the private individual in turn would lease to the community hospital for the purpose of advertising the community hospital's services.
93-008-E     Two county governmental entities following enabling legislation, along with a county area Chamber of Commerce, may create, fund, and support a not-for-profit Development Foundation, the Board of Directors of which are in part composed of members of the two county entities.

93-050-E     A city Councilman may serve on a county Convention and Visitors Bureau.

93 -086-E     1. A county Supervisor may not become employed by a business which contracts with the county.

2. A county Supervisor may become employed by a business which sells fuel to other businesses which contract with the county, provided...

3. A county Supervisor may become employed by a business which contracts with other governmental entities which are not units of the county
government.

93-093-E     1. A legal assistant may not sell law books to the District Attorney.

2. The spouse of the District Attorney may not remain his secretary following their marriage when her initial employment occurred before the marriage.

3. A District Attorney or a "relative" may not be paid from funds appropriated by the state for office expense allowance for monthly rental of real or personal property owned by him (or the "relative").

4. A School Attendance Officer may not be paid from the compulsory school attendance officer's office expense allowance rent for use of his home as an office.

93-109-E     A county tourism bureau may not contract with a private chamber of commerce when a person is a member of both governing boards.

93-113-E     A member of a County Board of Supervisors may not serve on the Board of a private county Chamber of Commerce (CCC) which is funded by the county.
93-124-E     An Assistant District Attorney may use a vehicle for official business which was provided him by a state narcotics unit, provided...
93-159-E     A county school board may not hire a "relative" of one of its former board members until one year has expired since the termination of the board member's membership.
93-173-E     An Industrial Development Authority (IDA) may not contract with a bank to sell it land when one of the IDA Commissioners is employed by the bank.
93-177-E     A Legislator may simultaneously serve as an uncompensated Trustee of a city/county library.

 93-220-E     1. A county Port Commission may not do business with a bank of which one of the Port Commissioners is an officer.

2. A county Port Commission may not do business with a bank which
employs the spouse of one of the Commission members.

3. A retired Commissioner holds a "de minimis" interest in a bank. The
commission should not do business with the bank until one (1) year has
expired since the commissioner retired.

93-226-E     An emancipated daughter of an E-911 Communications Center Commissioner may be an employee of E-911, provided...

92-007-E     Three members of a county hospital board of trustees may not do business with the hospital and/or the county board of supervisors. Violations: Section 109; 25-4-105(2).
92-010-E     A county supervisor may not become employed by a county tourism board or commission within one year of the expiration of his term of office, such agency formed as a result of state, local, and private legislation and implemented by a board of supervisors. Violations: Section 109; 25-4-105(2).
92-011-E     A member of a county hospital board may simultaneously serve as an elected county school board member.
92-012-E     A Legislator, following expiration of his term, may be appointed to the board of a county port authority.
92-037-E     1. The son of a county supervisor may not be employed by the county's CDC when son lives with the father. Violations: Section 109; 25-4-105(2).
2. The son's contribution to the financial upkeep of the parents' and his residence does not violate the ethics laws.
3. Since the son's employment began before the father took office, there will be no violation until such time as the board of supervisors authorizes any budget, etc., of the EDD. Then, violations: Section 109; 25-4-105(2).
4. A recusal by the father will not eliminate violations of Section 109 or 25-4-105(2).
92-038-E 1. The corporation in question is a private entity and not a "government" or governmental entity.
2. The CDA is effectively barred from the disclosure of non-public information. Section 25-4-105(5).
3. Individuals serving on the board of the CDA and EDD may contract with a private corporation which does no business with the board of which they are members.
4. A mayor and aldermen may contract with a private corporation which does no business with the board of which they are members.
5. Supervisors may contract with a private corporation which does no business with the board of which they are members.

92-043-E     A county school employee may publish a non-governmental newsletter on his own time, separate and apart from his county employment.
92-046-E     A county may contract for sand with one of its part-time employees who is considered the only source available.
92-048-E     Members of a community hospital board of trustees and its administrative employees may serve as members, board members or officers of a non-profit corporation organized by the hospital to provide outpatient health care services.
92-052-E     A person may not become a member of a county Economic Development Board (EDD) when he/she (1) is simultaneously an advisory board member of a county branch of a community college, (2) leases an office building to a department of the state, and (3) has a spouse who serves on a state commission. Violations: Section 109; 25-4-105(2).
92-053-E     A former out-of-state employee who otherwise does not do nay business with local or state government and receives no local or state funding, may be appointed to a county Economic Development Board.
92-059-E     A Legislator may not simultaneously serve a director of both a county juvenile center and a private boys and girls home. Violations: Section 109, re: Smith.
92-083-E     A supervisor may not become an employee of a private non-profit corporation partially supported by the county. Violations: Section 109; 25-4-105(2).
92-091-E     A county board of supervisors may designate the chairman and member of the county economic development district to serve as assistant purchase clerk for the county.
92-114-E     Fire protection districts are classified a both "government" and "governmental entity." Their members are" public servants."
92-115-E     A Legislator may sponsor a bill which passes thus enabling a county to create a non-profit corporation to which a board of supervisors may appoint the Legislator a member of the board of directors.
92-117-E     A business owner located in a county EDA, who possesses a loan in part authorized by the EDA, may be appointed to the board of directors of the EDA.
92-141-E     A person may be elected supervisor whose brother is a veteran service officer of the same county.
92-156-E     Must be viewed separately and are based upon a determination of fact.
92-158-E     A county may not contract with a business owned by a former supervisor whose term of office expired December 31, 1991 until January 1, 1993.
92-163-E     A rural electric power association may purchase land from one of its employees. Not public servants.
92-177-E     A levee board may issue an easement to a corporation which is contracting with one of the levee board members. Caution: 25-4-101.
92-184-E     A county consolidated school district board of trustees may not contract with a private corporation employing one of its trustees. Violations: 25-4-105(2); Section 109.
92-196-E     A county may contract with a driller-contractor to conduct additional landfill testing and analysis on property in which the contractor has an interest.
92-200-E     A vocational counselor of a county school district may not simultaneously be a member of the county school board. Violation: 25-4-105(3)(a).
92-212-E     A commissioner appointed by a county board of supervisors to a county development commission may become a candidate for city council of a city which is one of five cities which also appoints one commissioner or the CDC. Caution: 25-4-105(1).
92-235-E     A member of a county school board may simultaneously serve as a member of a county human resource agency.
91-004-E     A Legislator may become an employee of a 911 system. Caution: 25-4-105(1).
91-005-E     A Legislator may become employed as an assistant to the director of the county emergency operations center. Caution: 25-4-105(1).

91-006-E     A daughter of a board member of a county hospital may not become an employee of the hospital. Violations: Section 109; 25-4-105(2); 25-4-105(1).

91-011-E     1. A school board member may contract with his prior board after twelve months from the time hi resignation was effective.

2. The date of the former board member's interview depends upon several circumstances.
91-021-E     1. A county superintendent may recommend to the county school district board of education his future spouse as a principal. After their marriage, violation: 25-4-105(1).
2. The board, upon recommendation of the superintendent, may employ the principal/future spouse under a three year contract. Caution: 25-4-105(1).
91-023-E     A county E-911 supervisor may become a candidate for constable and if elected serve in both positions. Caution: 25-4-105(1).
91-045-E     A county industrial development authority may not do site improvement on land owned by one of its board members and located within the development district. Violations: Section 109; 25-4-105(2); 25-4-105(1).
91-046-E     An employee of a corporation locating in a county, said location financed in part by the issuance of general obligation bonds by the county acting through its county economic development district (EDD), may not be appointed to the board of trustees of the EDD. Violation: 25-4-105 (3)(a).
91-076-E     1. Does not deal with public employees.
2. A fire fighter may not simultaneously serve as Fire Protection District (FPD) board member. Violations: Section 109; 25-4-105(2); 25-4-105(1).
3. A county fire coordinator may simultaneously serve as a county supervisor.
4. The member of a public entity who violates the ethics laws is personally liable.
91-081-E     The spouse of a superintendent of education may be employed as a principal within the same district, provided very specific guidelines are strictly adhered to.
91-083-E     A bank may not bid on bonds issued for a county's economic development district (EDD) when a bank officer is simultaneously a trustee for the EDD. Violations: Section 109; 25-4-105(2).
91-099-E     A county may purchase with proceed of a community development block grant land owned by a member of a private non-profit water association.
91-101-E     1. A district attorney's spouse may serve as a county victim assistance coordinator.
2. A DA may serve as an adjunct faculty member or pursuant to federal grant as an instructor after hours or on weekends with an institute believed to be associated with a university.
3. A DA may recommend to a judge the treatment, supervision, counseling, etc., of probationers at a non-governmental facility employing the spouse of the DA.

91-103-E     Members of an ad hoc committee appointed to serve as an informal advisory board to a county EDD are not "public servants."
91-116-E     1. A newly elected county school superintendent may request the county board of education and the present superintendent of education to employ his spouse as a secretary before he is sworn into office. Strong caution: 25-4-101.
2. The spouse, so hired may serve as the elected superintendent's secretary after he is sworn into office until her term expires. Then, possible violation: 25-4-105(1).
3. The spouse of a newly elected superintendent may serve as his uncompensated secretary under the above appointment procedure until her term expires. Then, possible violation: 25-4-105(1).
91-120-E     The spouse of a county supervisor may not be employed by a community hospital located in and partially funded by the same county. Violations: Section 109; 25-4-105(2).
91-123-E     A county may not do business with a company employing one of the supervisors. Violations: Section 109; 25-4-105(1), (2), and (3)(a).
91-125-E     An attorney may not represent multi-governmental agencies within one geographic area and also a bank which does business with the county of which same attorney represents the board of supervisors. Possible violations: Section 109; 25-4-105(1), (3)(d) and (5).
91-126-E     A city councilman may or may not simultaneously be employed as a coordinator of a county's worthless check unit, depending upon Smith.
91-131-E     1. A Legislator may not own mare than 10% of a corporation which does ta subcontracting work on road construction projects funded, in part, by the Mississippi Highway Department. Violation: Section 109.
2. Dependent upon Smith.
3. Non-voting does not remove violations of Section 109.

91-134-E     A vice-president of a local labor union may be appointed as a commissioner of a port authority.
90-001-E     A governmental water and sewer district may hire as a maintenance technician an emancipated son of one of its commissioners.
90-006-E     An Emergency Communications District (ECD) commissioner may sell goods or services to units of the same county government. Caution: 25-4-105(1).
90-020-E     The first cousin of a sheriff may write bail bonds for the same county.
90-037-E     A state aid county engineer may, through his engineering firm, receive compensation for services provided in connection with a project of the same county's FDA. Cautions: 25-4-105(5); 25-4-101.
90-039-E     A Board of Fire Commissioners within a county district may not hire the fire chiefs son-in-law as a full-time fireman. Violation: 25-4-105(1).
90-057-E     A supervisor owning more than 10% interest in an automobile dealership may not contract to sell automobiles, parts, supplies, etc., to entities of the same county. Violations: Section 109; 25-4-105(2); 25-4-105(3)(a); 25-4-105(1).
90-075-E     An elected coroner may simultaneously be employed as an EMT of a county supported hospital.
90-076-E     A county attendance officer may simultaneously be employed as a census worker.
90-078-E     A board of supervisors may appoint a county employee (financial comptroller) as a member of a county commission (separate authority).
90-080-E     A Legislator may simultaneously be employed with a county's economic development district.
90-107-E     A manager of a county sewer district may not hire his emancipated son to help repair broken water pipes. Violations: 25-4-101; 25-4-105(1).

90-116-E     A member of a county park commission may simultaneously serve on the board of directors of a private group or organization which enters into written or oral agreements with the park commission for facility use and concession sales.

90-123-E     1. An attorney employed on a monthly retainer or hourly rate basis by a public agency is a "public servant."

2. A public agency's retained attorney may advocate a position consistent with that of his agency which enures to the benefit of a private client(s).
90-130-E     The emancipated daughter of a candidate for county supervisor may continue in her employment position after the father/supervisor takes office.
90-134-E     A county road manager may not sell gravel to a general contractor who is responsible for providing labor and materials responsive to a state aid contract let by the same county. Violations: 25-4-105(3)(a); 25-4-101.
89-49-E     A state bond attorney, who is also a member of a County Development Commission (CDC), may carry out his official (bond) duties when the county in which the CDC is located issues bonds on behalf of the Commission, if the county does not have any rule or regulation requiring the CDC to approve bond issues. Caution: 25-4-105(1). Otherwise, Violations: Section 109; 25-4-105(2). Recusal will eliminate violation of 25-4-105(1), but not Section 109 or 25-4-105(2).
89-60-E     A member of the Board of Commissioners of a state Post Authority may vend to a customer of the Authority, when an enabling license issued by the board of commissioners is a prerequisite. Reference: Asseme. Cautions: 25-4-105(1); 25-4-105(5).
89-105-E     A city commissioner may simultaneously serve as an appointed member of a county industrial development authority.
89-108-E     A supervisor may receive per diem as a member of a county port commission.
89-168-E     1. A member of a county EDA as an insurance agent may not write a surety bond for the EDA. Violation: 25-4-105(3)(a).
2. Other issues to be decided on a case by case basis.
89-173-E     A Legislator may simultaneously serve as a director of both a county juvenile center and a private boys and girls home.
89-181-E     A member of a city-county airport board may not establish and operate a flying service at the same airport. Violations: Section 109; 25-4-105(2); 25-4-105(3)(a); 25-4-105(1).
88-171-E     The emancipated son of an supervisor may be employed by the county sheriffs department, provided the father does not violate Section 25-4-105(1).
87-02-E     Members of an Economic Development Authority (EDA) may not have an interest in projects approved by the EDA with subsequent approval by other public bodies. Violations: 25-4-105(2)(f); Section 109.
87-28-E     An father-in-law of an elected supervisor may continue as an employee of the supervisor's beat, as the father-in-law is not a "relative" under 25-4-103(p).
87-30-E     A county Supervisor may be employed by a company which utilizes the county Industrial Park and the county Port and Harbor (PHC), both largely owned by the county, since the county will have no part in the supervisor's contract of employment. However, the supervisor should recuse himself from deliberations concerning the PHC rates.
87-32-E     The spouse of an Alderman may be employed by the city school system, as long as the funding of the school district is mandatory and in no part discretionary. Otherwise, a violation of Section 109 would occur. Reference: 87-16-E.
87-36-E     A medical staff doctor may simultaneously serve in a limited and restrictive manner on the hospital's board of trustees up and until, but not beyond, the time the Board considers his/her reappointment to the medical staff. Possible violations: Section 109; 25-4-105(2)(f).
87-43-E     A member of the Legislature may sell insurance to a county hospital provided that premiums to be paid under the proposed contract are not contingent upon the hospital's receipt of Medicaid funds. Possible violations: 25-4-105(10) and (4).
87-46-E     The business partner (through business 1) of a member of the Legislature may contract, through a separate and distinct business (business 2), with a school district as a low bidder on a walkway project, provided the Legislator has no financial or other interest in the second business (business 2), and that none of the monies gained would flow to the Legislator or his business (business 1).
87-50-E     A director of a depository selected by the board of supervisors may simultaneously serve as a member of the county port commission when port commission funds are placed in the depository, because the port commission has no authority over the selection of its depository.
87-52-E     The spouse of a school board member may not be employed by that school board. Violations: Section 109; 25-4-105(2)(f)
87-58-E     1. Employees of a local school district may be elected and serve as members of the city's council. Reference: 87-16-E.

2. The employees of the school district/councilpersons, must recuse themselves from participation, official or unofficial, in discussions of school budgets and school board appointments. Reference: 87-16-E.

3. The vote of a school district employee, while also serving as councilperson, may not be counted and is null and void. [Friedhoff v. City of Biloxi(1957), Jackson Redevelopment Authority v. King. Inc.(1978)].
87-60-E     The emancipated son of a member of the board of a local health department may contract with that agency, provided there are no violations of 25-4-105(1) and (4).
87-69-E     The spouse of an appointed member of a county board of supervisors may not continue to be employed by the county in the Tax Assessor's office, as the budget for the office is approved by the board of supervisors. Violation: 25-4-l05(2)(f).
87-70-E     A member of a county board of supervisors may sell items to a county school district located within the same county, because the county's funding of the school district is mandatory and in no way discretionary.
87-77-E     A county sheriff may contract with a county recreation department for the lease of golf carts, because the recreation department is a "separate authority" under 25- 4-103(a).
87-78-E     A bank may not be designated as the depository for a community hospital when a member of the board of the community hospital holds a material financial interest in the bank. Violations: 25-4-105(2)(f); Section 109.
87-101-E     A legislator may simultaneously serve as an employee of a county sheriffs department, provided recusal.
87-104-E     A supervisor may contract with the board of which he is a member when the contract execution is federally mandated and the amount for collection of charges, along with the amount of the charges themselves, is determined by an independent firm, and not by the board or the company of the supervisor.
