COUNTY SHERIFF
95-005-E     Do the Mississippi Ethics in Government laws prohibit the spouse of a county sheriff from being appointed by the county/youth court judge as the county court administrator within the same county in which the sheriff is a county elected official? [13, 27, 28, A]
95-010-E     Are the Mississippi Ethics in Government laws violated should:
1. a municipality's acting chief of police qualify as a candidate for justice court judge without taking a leave of absence; and
2. a municipal police officer qualily as a candidate for sheriff without taking a leave of absence? [5, 7, 13, 29, M]
95-019-E     Are the Mississippi Ethics in Government laws violated should a sheriff's department lease from one of its deputy sheriff's a motor vehicle for use as a drug protection canine unit for $1.00 a month and provide the necessary liability and collision insurance coverage? [9, 11, 13]
95-022-E     Are the Mississippi Ethics in Government laws violated should a sheriff marry an employee of the sheriff's department and retain her as an employee after the marriage? [11,13, A]
95-061-E     It is not a violation of the conflict of interest laws for the county sheriff's niece to serve as a bail bond agent in the sheriff's county but the sheriff should be especially cautious of 25-4-105(5). [3, 13, 31]
95-064-E     It is not a violation of the conflict of interest laws if a dispatcher is employed by a county sheriff's department, who also is a licensed bail bond agent, and is writing bail bonds returnable to judicial and law enforcement entities other than those of his or her employing county. Cautioned as to 254-105(1) and (5). Prohibition as to 25-4-105(3)(a) writing bail bonds to entities of employing county. [11,3, 13]
95-121-E     An individual elected to the office of constable may not continue to work as a deputy sheriff for the county he or she was elected to serve as constable. [13, 16]

92-225-E     1. A constable may simultaneously serve as a collection agent for the county justice court.
2. A constable may receive a $20 fee for serving arrest warrants in the capacity of collection agent.

91-060-E     1. An elected constable may serve as a full-time sheriffs department investigator under the ethics laws. (Referred to AG.)

2. The constable/sheriffs investigator may not perform constable duties and receive consequent fees while on duty for the sheriffs department. Violation: 25-4-105(1); 25-4-101.
90-020-E     The first cousin of a sheriff may write bail bonds for the same county.
89-09-E     A sheriff may not employ a spouse, parent or child on a part-time basis when full-time employees are on vacation. Violation of Section 109 and 25-4-105(2) if a spouse or dependent child or parent. Violation of 25-4-105(1).
89-29-E     A sheriff's employment of his spouse as a dispatcher following the resignation of the prior dispatcher violates Section 109 and 25-4-105(2).
89-36-E     A board of supervisors may contract with a private security company to transport prisoners which is owned by the sheriff's sons. Cautioned regarding 25-4-101 and 25-4-105(1).
88-30-E     A sheriffs department may not purchase tires from a company owned by the son of the sheriff. Violation: 25-4-105(1).
88-172-E     A deputy sheriff/owner of a plumbing contracting business may not contract with the board of supervisors, as that is the same governmental entity of which he is an employee. Violation: 25-4-l05(2)(a).
88-176-E     A former supervisor may not be employed by the county sheriffs department prior to the expiration of one year after he left office. Violation: 25-4-105(2)(f).
87-77-E     A county sheriff may contract with a county recreation department for the lease of golf carts, because the recreation department is a "separate authority" under 25-4-103(a).
87-l01-E     A legislator may simultaneously serve as an employee of a county sheriffs department, provided recusal.
